At 6:30 a.m. at the intersection of Bear Valley Road, a 14-year-old with an infectious laugh was struck and killed by a green Ford Explorer. Alex De La Cruz was on his way to class at Apple Valley High School. While tragic, his death was not the first to occur at this time, at this intersection. In 2003 and 2004, two children were killed in similar, inauspicious circumstances. Parents and school officials alike begged the town to enhance the safety of the intersection, but Apple Valley officials failed to act.
Inspiring Change
The De La Cruz family wants nothing more than to know that their $60 million award will inspire the town to make changes and prevent the devastation of other families in the future. With warning signs and a 25-mph speed limit, Alex might still be alive.
In agreement with our clients, Attorney William Paoli stated:
“The whole point of this is we can’t compel them to change it. But next time someone gets hit out there, I would think that now with this verdict that would cause them to reconsider their interpretation of the code.”
The award may spur change within Apple Valley, but the De La Cruz family continues to grieve. To honor his memory, Alex’s father now goes to Knott’s Berry Farm and rides Alex’s favorite coaster, “GhostRider,” with an empty seat open for his son. The entire family of 7 misses the energy and contagious laughter of 14-year-old Alex, who always insisted on walking to school in order to stop by his preferred doughnut shop.
Accepting Liability
Because this tragedy was entirely preventable, Apple Valley was found liable for Alex’s death. The town wishes to appeal the jury’s verdict, but they would be best served by taking action to prevent this kind of accident in the future. Meanwhile, the family will not have to worry about finances during this difficult time.
